By accessing and using the Average app ("the App"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using the App's particular services, you shall be subject to any posted guidelines or rules applicable to such services.
Average allows users to compare their personal statistics with global averages. You agree to use the App only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the App.
The App may request access to your HealthKit data to provide accurate comparisons. This data is used solely for the purpose of functionality within the App and is not sold to third parties. You maintain full control over which data categories you share.
The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the App are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights.
The materials on the App are provided "as is". We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
In no event shall ZBGC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the App.
